Heavenly Father, we come before You this morning as we begin our legislative session humbly asking that You watch over us as we make critical decisions that will affect this wonderful state and the people who live within its borders. Let us be respectful of each other, realizing that while we may disagree on specifics, we all share a common goal in doing what is best for those You have given us the privilege to represent. Senate Bill No. 1313, entitled

A bill to amend 1961 PA 108, entitled "An act to provide for loans by the state of Michigan to school districts for the payment of principal and interest upon school bonds; to prescribe the terms and conditions of the loans and the conditions upon which levies for bond principal and interest shall be included in computing the amount to be so loaned by the state; to prescribe the powers and duties of the superintendent of public instruction and the state treasurer in relation to such loans; to provide for the repayment of such loans; to provide incentives for repayment of such loans; to provide for other matters in respect to such loans; and to make an appropriation," (MCL 388.951 to 388.963) by adding section 3a.

A bill to amend 2001 PA 34, entitled "Revised municipal finance act," by amending sections 317, 403, 611, and 701 (MCL 141.2317, 141.2403, 141.2611, and 141.2701).

A bill to amend 1965 PA 285, entitled "Private detective license act of 1965," by amending the title and sections 2, 3, 5, 6, 7, 9, 10, 11, 12, 13, 16, 17, 18, 22, 23, 24, 25, 26, 27, 28, and 31 (MCL 338.822, 338.823, 338.825, 338.826, 338.827, 338.829, 338.830, 338.831, 338.832, 338.833, 338.836, 338.837, 338.838, 338.842, 338.843, 338.844, 338.845, 338.846, 338.847, 338.848, and 338.851.

Substitute (S-2).

The following are the amendments to the substitute recommended by the Committee of the Whole:

1. Amend page 9, line 10, after "application" by inserting a comma and "APPLICATION PROCESSING FEE,".

2. Amend page 10, line 1, after "DEPARTMENT" by striking out the balance of the line through "filing" on line 4 and inserting "AN APPLICATION PROCESSING FEE OF $150.00 AND AN INITIAL LICENSE FEE OF $600.00. THE APPLICANT SHALL EXECUTE, DELIVER, AND FILE".

3. Amend page 11, line 15, after "license" by striking out the balance of the subsection and inserting "OR APPLICATION PROCESSING FEE OR ANY PART OF THE LICENSE OR APPLICATION PROCESSING FEE.".

4. Amend page 11, following line 16, by inserting:

Senator Miller's statement is as follows:

I voted "no" on the State Police budget because I really don't know why we call it the State Police budget. We had an opportunity to help the state police. The state police are recognized as the premier police organization of this state. This language was in in the House. It has been here for years. We have never, never put our state police troopers to the test that whoever writes the most tickets gets the biggest promotion. I think that you're giving the public a perception that is what the state police unit is turning into--a very, very politicized unit. I don't think that we should. I think we should give the men and women who protect our citizens the utmost confidence and trust. I think that when this bill comes back, I hope that good Senator DeBeaussaert offers the language again. Maybe by that time some of our troopers across the state can convince the other side that they should be more interested in putting that amendment back in than they are for voting for immediate effect.

A resolution honoring the distinguished service of Ron Pemberton of the Great Lakes Newfoundland Club.

Whereas, After 38 years of service in both Illinois and Michigan, including 35 years in the Livonia Public School District, Ron Pemberton retired as an educator; and

Whereas, Ron Pemberton, along with his wife Erma and nine others, assisted in forming a regional Newfoundland dog club. Today, the Great Lakes Newfoundland Club has well over 200 members and serves as one of the leading regional Newfoundland dog clubs in the United States; and

Whereas, On behalf of the Newfoundland Club of America and the Great Lakes Newfoundland Club, Ron Pemberton personally chaired three Independent Newfoundland Club of America National Specialty Dog Shows. On two occasions, he served as a judge at this annual event. As an exhibitor at this event, dogs that Ron has either owned or bred have won Best of Opposite Sex, Winners, and High in Trial awards. Further, his dogs have earned first place in the Bred by Exhibitor and Open Other Than Black classes; and

Whereas, To this date, his bitch Topmast's Prairie Snow is the only Newfoundland dog that has earned both the Judges' Choice and the People's Choice award at the prestigious Top Twenty Event. The Top Twenty Event is held most years in conjunction with the Independent National Specialty; and

Whereas, Ron was elected and is a past member of the board of directors for the Newfoundland Club of America. As an NCA member, he has served in various capacities, including committees regarding the breed standard, Newfoundland illustrated guide, judges education, and memorial trophies. Ron is primarily responsible for an expansion of the Orthopedic Foundation for Animals Newfoundland dog data base; and

Whereas, For eleven years, he chaired the NCA Hip Dysplasia Committee. This committee was responsible for compiling and distributing an annual booklet entitled A Guide Book to the Orthopedic Foundation of America Certified Normal Newfoundland Dog; and

Whereas, Most recently, in conjunction with the Tate Museum of London and the Newfoundland Club of America, Ron spearheaded a successful fund-raising campaign for the restoration of the Sir Edwin Landseer painting A Distinguished Member of the Humane Society. The painting had fallen into a deteriorating condition, and the restored painting is presently on display at the Philadelphia Museum of Art; and

Whereas, As a Newfoundland dog breeder under the Holiday prefix, Ron Pemberton has taken great pride in producing and/or owning an estimated 50 champions. This includes the first Newfoundland to have earned both Confirmation and Utility Dog titles in the United States and/or Canada. Coincidently, four of the first ten dogs to have earned NCA Water Dog titles carried his Holiday prefix in their names; and

Whereas, Known for excellence in the confirmation arena, Ron has maintained a Newfoundland dog breeding program that has stressed the importance of temperament, performance, form, and function of the Newfoundland dog. Two of his Holiday-bred dogs have earned NCA Registry of Merit awards and two have been awarded Versatility titles; and

Whereas, As a judge educator and breeder judge, Ron has authored a detailed breed study entitled "A Study of the Newfoundland"; and

Whereas, In recent years, Ron has served the Detroit Kennel Club as first vice-president. Each year, the DKC is one of only a handful of all-breed kennel clubs nationwide that sponsors a benched all-breed dog show in the public's interest; and

Whereas, In 1978, Ron envisioned a dog judges' group that would enable and assist registered AKC judges and those persons aspiring to judge to learn about standards for various breeds of dogs. Since that time, he has spearheaded the highly successful Michigan Dog Show Judges' Association. He has been responsible for creating the concept of offering judges six breed seminars per year as conducted by some of the top breeders, exhibitors, and handlers of each breed presented. Many of these presenters have traveled great distances to create this hands-on learning experience for the club's membership. The quality of these seminars reflect Ron's devotion to the sport of purebred dogs and his constant drive to learn and share information about each breed; now, therefore, be it

Today, as we deliberated legislation before us, I had a constituent who were watching from the north Gallery. Maureen Carter was here today to job shadow me as a student with Partners in Policymaking. Partners in Policymaking is a wonderful program that teaches parents of children with disabilities, as well as people with disabilities themselves, to advocate on behalf of programs and issues that are important to them. I hope that Maureen will have had a successful day watching us debate. She also works for the city of Monroe, so I know she was very interested in the General Government budget that we did as well.

 

Senator Scott's statement is as follows:

Getting back to my city of Highland Park. I noticed that a number of my colleagues were in favor of the lottery and gaming. So, since they won't help me get anything else, I will accept a casino in the city of Highland Park. I can get some of those revenues there.

 

Senator Schwarz's statement is as follows:

Just to show you that we do some smart things around here on occasion, and they get some results. If you can recall last year, we appropriated $2.5 million to Wayne State University Medical School to help them retain the federal perinatal research organization at the Wayne State University Medical School. This was to refurbish laboratories in the building that houses the perinatal research labs and the perinatal research operation. This is an operation that is an extramural activity of the National Institutes of Health. It is a very prestigious organization and is at Wayne State University because it is probably the best place in the country to study the prenatal, perinatal, and postnatal complications, especially in a large urban population.

I'm happy to announce this morning that Wayne State University Medical School did win the competition to continue to have the perinatal research unit at Wayne State University Medical School. I'm also happy to tell you who they beat out--Yale.

A bill to amend 1964 PA 170, entitled "An act to make uniform the liability of municipal corporations, political subdivisions, and the state, its agencies and departments, officers, employees, and volunteers thereof, and members of certain boards, councils, and task forces when engaged in the exercise or discharge of a governmental function, for injuries to property and persons; to define and limit this liability; to define and limit the liability of the state when engaged in a proprietary function; to authorize the purchase of liability insurance to protect against loss arising out of this liability; to provide for defending certain claims made against public officers and paying damages sought or awarded against them; to provide for the legal defense of public officers and employees; to provide for reimbursement of public officers and employees for certain legal expenses; and to repeal certain acts and parts of acts," by amending the title and sections 8 and 9 (MCL 691.1408 and 691.1409), the title as amended by 1986 PA 175.
