Senate Bill No. 1013, entitled

A bill to amend 1995 PA 29, entitled "Uniform unclaimed property act," by amending section 19 (MCL 567.239), as amended by 1997 PA 195, and by adding section 8b.

The question being on the passage of the bill,

Senator Switalski offered the following amendment:

1. Amend page 2, line 17, by striking out all of section 19 and inserting:

"Sec. 19. (1) The administrator shall cause a notice to be published ~~not later than November 1 of~~ twice annually the year immediately following the report required by section 18 in a newspaper ~~of general circulation in the county of this state in which is located the last known address of any person named in the notice~~ that has statewide circulation. If no address is listed or the address is outside this state, the notice must be published in the county in which the holder of the property has its principal place of business within this state or another county The notice may be published in other newspapers that have statewide circulation as determined by the administrator.

(2) The published notice shall be entitled "notice ~~of names of~~ to persons ~~appearing to~~ and entities who may be owners of abandoned property" and contain all of the following:

(a) ~~The names, in alphabetical order, of persons listed in the report and entitled to notice within the county as specified in subsection (1).~~ A statement that new properties have been added to the unclaimed property division website.

(b) The department's website address. The website will enable persons and entities to search for their abandoned property.

(c) The department's telephone number for persons and entities to contact the department via telephone in search of their abandoned property.

(3) The website shall contain all of the following:

(a) The name of any person for which property has been added to the unclaimed property division database.

(b) A statement that information concerning the property may be obtained by any person possessing an interest in the property by addressing an inquiry to the administrator.

(c) A statement informing an owner of property held by the administrator on how to file a claim with the administrator to receive his or her property.

(4) ~~(3)~~ The administrator is not required to publish ~~in the notice~~ on the website any items of less than $50.00 unless the administrator considers ~~their~~ publication of 1 or more of those items to be in the public interest.

~~(4) This section is not applicable to sums payable on travelers checks, money orders, and other written instruments presumed abandoned under section 5.~~".
