CONTENT


The bill would amend the Administrative Procedures Act to do the following:

 

--    Specify that the official Michigan Administrative Code would be the Code that is published or made available on the Office of Regulatory Reform’s (ORR’s) Internet website free of charge.

--    Eliminate current distribution requirements for the Code, annual supplements to the Code, and the Michigan Register.

--    Require the ORR’s publication of annual supplements to the Code to be in electronic format.


The Code is a compilation of the administrative rules that have been promulgated by State departments and agencies. The Michigan Register must be published once each month and contain certain information prescribed in the Act, such as Executive Orders, the number and subject matter of enrolled Senate and House bills, proposed administrative rules, and Attorney General Opinions.


The bill would delete a requirement that the Department of Management and Budget (DMB), unless otherwise directed by the ORR, deliver and provide copies of the Code, an annual supplemental to the Code, and the Michigan Register, to the Secretary of the Senate and the Clerk of the House of Representatives, in a sufficient number to supply each Senator and Representative.


Currently, a person may subscribe to the Michigan Register, the Code, and the annual supplementals for a fee, which may not exceed publication and distribution costs, as determined by the ORR. The bill provides that the DMB, rather than the ORR, would determine the subscription fee.

FISCAL IMPACT


The bill would result in savings of approximately $46,000 from the elimination of printing and distribution costs.
