ADULT FOSTER CARE LICENSE REFUND H.B. 5882 (H-1): FLOOR ANALYSIS

House Bill 5882 (Substitute H-1 as reported without amendment)
Sponsor: Representative Gary Newell
House Committee: Government Operations
Senate Committee: Economic Development, Small Business and Regulatory Reform

CONTENT
The bill would amend the Adult Foster Care Facility Licensing Act to delete a provision under which a fee collected by the Family Independence Agency (FIA) under the Act may not be refunded.

The bill is tie-barred to Senate Bill 1215, which would amend the Act to require the FIA to issue or deny a license within six months after receiving a completed application, and refund the license fee if it failed to comply with the time requirement.

FISCAL IMPACT
The bill would have no fiscal impact on the Family Independence Agency. The amendment would allow for the refund of license application fee collections, which would be approximately $21,885 if the FIA failed to meet the deadline in every case, under Senate Bill 1215. House Bill 5882 (H-1) would have no additional fiscal impact.
