                           HOUSE BILL NO. 4495                                  

                                                                                

                                                                                

                                                                                

                                                                                

                                                                                

                                                                                

                                                                                

                                                                                

                                                                                

                                                                                 A bill to amend 1949 PA 300, entitled                                             

                                                                                

    "Michigan vehicle code,"                                                    

                                                                                

    (MCL 257.1 to 257.923) by adding section 675e.                              

                                                                                

                THE PEOPLE OF THE STATE OF MICHIGAN ENACT:                      

                                                                                

1       Sec. 675e.  (1) Upon new construction of, resealing of, or                  

                                                                                

2   resurfacing of existing handicapped van accessible parking spaces           

                                                                                

3   required by law or rule, parking spaces, curb cuts, and access              

                                                                                

4   aisles shall conform to the specifications for accessible and               

                                                                                

5   usable buildings and facilities prescribed in the American                  

                                                                                

6   national standard 1998, ICC/ANSI A117.1.                                    

                                                                                

7       (2) The area between each van accessible handicapped parking                

                                                                                

8   space required under subsection (1) shall be painted with blue              

                                                                                

9   diagonal stripes that are 4 inches wide and 24 inches center to             

                                                                                

10  center.                                                                     

                                                                                

11      (3) A person who violates this section is responsible for a

1   civil infraction and subject to a fine of $100.00, and an                   

                                                                                

2   additional fine of $100.00 for each 30-day period after the                 

                                                                                

3   citation is issued during which the violation remains uncured.              

                                                                                

4   However, the total fine shall not exceed $1,000.00.                         

                                                                                

5       (4) As used in this section, "person" means a person, as                    

                                                                                

6   defined in section 40, who is the sole or part owner of a parking           

                                                                                

7    lot.
