SUBSTITUTE FOR
HOUSE BILL NO. 4326
A bill to amend 1969 PA 306, entitled
"Administrative procedures act of 1969,"
by amending sections 55 and 59 (MCL 24.255 and 24.259), as
amended by 1999 PA 262.
THE PEOPLE OF THE STATE OF MICHIGAN ENACT:
1 Sec. 55. (1) The
office of regulatory reform annually
2 shall publish a an
electronic supplement to the Michigan
3 administrative code. The annual supplement shall contain all
4 promulgated rules published in the Michigan register during the
5 current year, except emergency rules, a cumulative numerical
6 listing of amendments and additions to, and rescissions of rules
7 since the last printed compilation of the Michigan administrative
8 code, and a cumulative alphabetical index.
9 (2) The Michigan
administrative code and, if applicable, the
10 annual supplements
shall be made available by the office of
1 regulatory reform free
of charge on the internet and in printed
2 or other electronic
format for public subscription at a fee
3 reasonably calculated
to cover publication and distribution
4 costs.
5 Sec. 59. (1) The office of regulatory reform shall publish
6 or order published a
sufficient number of copies of the
7 Michigan register, the Michigan administrative code, and the
8 annual supplement to the Michigan
administrative code to meet
9 the requirements of
this section. Unless otherwise directed by
10 the office of
regulatory reform, the department of management and
11 budget shall deliver
or provide copies as follows: free
of
12 charge on the office of regulatory reform's internet website and
13 may publish these documents in printed or other electronic format
14 for public subscription at a fee, determined by the department of
15 management and budget, that is reasonably calculated to cover,
16 but not to exceed, the publication and distribution costs. Any
17 money collected by the department of management and budget from
18 subscriptions shall be deposited into the general fund.
19 (a) To the
secretary of the senate, a sufficient number to
20 supply each senator.
21 (b) To the clerk
of the house of representatives, a
22 sufficient number to
supply each representative.
23 (2) The copies of
the Michigan register, the Michigan
24 administrative code,
and the annual Michigan administrative code
25 supplement are for
official use only by the agencies and persons
26 prescribed in
subsection (1), and they shall deliver them to
27 their successors. The
department of management and budget shall
1 hold additional copies
for sale at a price not less than the
2 publication and
distribution costs which shall be determined by
3 the office of
regulatory reform. Any money collected by the
4 department of
management and budget for the administrative code
5 under this subsection
is to be deposited into the general fund.
6 (3) A person may
subscribe to the Michigan register, the
7 Michigan administrative code, and the annual supplement to the
8 Michigan administrative code. The office of regulatory reform
9 shall determine a
subscription price that shall not be more than
10 the publication and
distribution costs.
11 (2) The official Michigan administrative code is that
12 published or made available on the office of regulatory reform's
13 internet website free of charge.
