A bill to amend 1982 PA 415, entitled
"Correctional officers' training act of 1982,"
by amending section 12 (MCL 791.512), as amended by 1989 PA 4.
THE PEOPLE OF THE STATE OF MICHIGAN ENACT:
1 Sec. 12. (1) Except
as provided for in subsections (2),
2 and (3), and (4), a person who is not employed as
a state
3 correctional officer on March 30, 1983 and who is not employed as
4 a state correctional officer until after December 31, 1984, shall
5 not be certified or recertified by the Michigan commission of
6 corrections unless he or she has done all of the following:
7 (a) Obtained a high school diploma or attained a passing
8 score on the general education development test indicating a high
9 school graduation level.
10 (b) Successfully completed all of the following:
11 (i) One of the following:
1 (A) A vocational certificate program as determined by the
2 council, earned from an accredited postsecondary educational
3 institution, which program shall require a minimum of 15 semester
4 credit hours or 23 term credit hours.
5 (B) Equivalent course work to a vocational certificate
6 program, as determined by the council, earned from an accredited
7 postsecondary educational institution, which course work shall
8 require a minimum of 15 semester credit hours or 23 term credit
9 hours. The credit hours required under this subparagraph may
10 be have been earned before or after the
effective date of the
11 amendatory act that
added this subparagraph at any
time.
12 (C) A degree granted by an accredited postsecondary
13 educational institution in a major discipline of study that is
14 relevant to the position of state correctional officer, as
15 determined by the council. A degree required under this
16 subparagraph may be have
been earned before or after the
17 effective date of the
amendatory act that added this
18 subparagraph at any time.
19 (ii) A minimum of 2 months of supervised, paid internship, as
20 determined by the council, as an intern in a correctional
21 facility.
22 (iii) A minimum of 320 hours of new employee training, as
23 determined by the council, at the central training academy.
24 (c) Fulfilled other minimum standards and requirements
25 developed pursuant to section 13 by the council and approved by
26 the commission of
corrections department for certification and
27 subsequently for recertification.
1 (2) A person who is
was employed as a correctional officer
2 or an immediate supervisor of a correctional officer at the
3 former Detroit house of correction on December 31, 1984 shall
4 automatically be certified and annually recertified by the
5 Michigan commission
of corrections department
until
6 December 31, 1985.
Beginning January 1, 1986, a person who is
7 was employed as a correctional officer or an immediate supervisor
8 of a correctional officer at the former Detroit house of
9 correction on December 31, 1984 shall not be recertified unless
10 he or she has done both of the following:
11 (a) Completed successfully a minimum of 160 hours of training
12 provided by the department.
13 (b) Fulfilled other minimum standards and requirements for
14 recertification developed pursuant to section 13 by the council
15 and approved by the commission
of corrections department.
16 (3) A department of mental health direct care employee of a
17 state facility officially designated for closure or phase-down
18 due to deinstitutionalization, or a forensic security aide II or
19 III employed by the department of mental health center for
20 forensic psychiatry, or a work camp supervisor employed by the
21 department of corrections shall automatically be certified and
22 annually recertified by
the commission of corrections
23 department for 3 years following the date he or she became
24 employed as a state
correctional officer, provided if he or she
25 has done all of the following:
26 (a) Within 1 year of the date he or she became employed as a
27 state correctional officer, obtained a high school diploma or
1 attained a passing score on the general education development
2 test indicating a high school graduation level.
3 (b) Within 1 year of the date he or she became employed as a
4 state correctional officer, completed successfully 320 hours of
5 new employee training with a credit up to 160 hours of previously
6 acquired training, as approved by the council.
7 (c) Within 3 years of the date he or she became employed as a
8 state correctional officer, completed 1 of the following:
9 (i) A vocational certificate program, as determined by the
10 council, earned from an accredited postsecondary educational
11 institution, which program shall require a minimum of 15 semester
12 credit hours or 23 term credit hours.
13 (ii) Equivalent course work to a vocational certificate
14 program, as determined by the council, earned from an accredited
15 postsecondary educational institution which course work shall
16 require a minimum of 15 semester credit hours or 23 term credit
17 hours. The credit hours required under this subparagraph may
18 be have been earned before or after the
effective date of the
19 amendatory act that
added this subparagraph at any
time.
20 (iii) A degree granted by an accredited postsecondary
21 educational institution in a major discipline of study that is
22 relevant to the position of state correctional officer, as
23 determined by the council. A degree required under this
24 subparagraph may be have
been earned before or after the
25 effective date of the
amendatory act that added this
26 subparagraph at any time.
27 (d) Fulfilled other minimum standards and requirements

1 developed pursuant to section 13 by the council and approved by
2 the commission of
corrections department for certification and
3 subsequently for recertification.
4 (4) An employee of the department of community health who is
5 employed as a forensic security aide at the Huron valley center
6 of the [department of community health] or the center for forensic
7 psychiatry of the department of community health, and who is
8 transferred to a position as a state correctional officer
9 employed by the department of corrections, shall be automatically
10 certified and recertified by the department for 3 years after the
11 date on which he or she became employed as a state correctional
12 officer, if he or she meets all of the requirements established
13 by law or by the department for employment as a state
14 correctional officer and does all of the following:
15 (a) Within 30 days after the effective date of the 2004
16 amendatory act that amended this section, declares his or her
17 intent to accept the transfer to a position as a state
18 correctional officer.
19 (b) Within 1 year of the date he or she became employed as a
20 state correctional officer, obtained a high school diploma or
21 attained a passing score on the general education development
22 test indicating a high school graduation level.
23 (c) Within 1 year of the date he or she became employed as a
24 state correctional officer, completed successfully 320 hours of
25 new employee training with a credit up to 160 hours of previously
26 acquired training, as approved by the council.
27 (d) Fulfilled other minimum standards and requirements,
1 except for physical fitness requirements, developed pursuant to
2 section 13 by the council and approved by the department for
3 certification and subsequently for recertification.
4 (5) (4) All
minimum standards and requirements for
5 certification and subsequently for recertification of persons
6 under subsections (1),
(2), and (3), shall be and (4) are
7 subject to approval by the state civil service commission.
