SUBSTITUTE FOR
HOUSE BILL NO. 6206
A bill to amend 1943 PA 184, entitled
"Township zoning act,"
(MCL 125.271 to 125.310) by adding section 16i.
THE PEOPLE OF THE STATE OF MICHIGAN ENACT:
1 Sec. 16i. (1) An owner of land may voluntarily offer in
2 writing, and the township may approve, certain use and
3 development of the land as a condition to a rezoning of the land
4 or an amendment to a zoning map.
5 (2) In approving the conditions under subsection (1), the
6 township may establish a time period during which the conditions
7 apply to the land. Except for an extension under subsection (4),
8 if the conditions are not satisfied within the time specified
9 under this subsection, the land shall revert to its former zoning
10 classification.
11 (3) The township shall not add to or alter the conditions
1 approved under subsection (1) during the time period specified
2 under subsection (2).
3 (4) The time period specified under subsection (2) may be
4 extended upon the application of the landowner and approval of
5 the township.
6 (5) A township shall not require a landowner to offer
7 conditions as a requirement for rezoning. The lack of an offer
8 under subsection (1) shall not otherwise affect a landowner's
9 rights under this act, the ordinances of the township, or any
10 other laws of this state.
