A bill to amend 1990 PA 187, entitled
"The pupil transportation act,"
by amending section 59 (MCL 257.1859), as amended by 1996
PA 170.
THE PEOPLE OF THE STATE OF MICHIGAN ENACT:
1 Sec. 59. (1) A driver of a school bus shall not transport
2 or permit to be transported on a school bus while transporting
3 pupils to and from school a person other than pupils, persons
4 enrolled in a school-sponsored preschool program authorized by
5 state or federal statute, teachers or chaperons of the pupils, a
6 person described in subsection (2), or other persons authorized
7 by the school for the protection of property or the health,
8 safety, and welfare of the pupils or persons attending other
9 school related functions, or both. This subsection shall not
10 apply during the transportation of persons under section 65.
1 (2) A school transporting pupils with special needs shall
2 also furnish an aide on that school bus to provide any assistance
3 necessary to those pupils.
4 (3) (2) After
the fourth Friday following Labor day of each
5 school year a school bus shall not be used to transport more than
6 100% of the number of persons for which the school bus has a
7 rated seating capacity.
8 (4) (3) A
person who violates or directs a violation of
9 this section is responsible for a civil infraction and may be
10 ordered to pay a civil fine of not more than $100.00. A civil
11 infraction under this subsection shall be processed in the same
12 manner as a civil infraction under the Michigan vehicle code,
13 Act No. 300 of the
Public Acts of 1949, being sections 257.1 to
14 257.923 of the
Michigan Compiled Laws 1949 PA
