A bill to amend 1931 PA 328, entitled
"The Michigan penal code,"
(MCL 750.1 to 750.568) by adding section 411t.
THE PEOPLE OF THE STATE OF MICHIGAN ENACT:
1 Sec. 411t. (1) A lessor of rental property who knowingly
2 allows the manufacture, delivery, or possession of controlled
3 substances, as described in subsection (2), to be conducted by
4 another person on or in the rental property is guilty of a
5 misdemeanor, punishable by imprisonment for not more than 180
6 days or a fine of not more than $5,000.00, or both.
7 (2) Subsection (1) applies to the following prohibited acts:
8 (a) A violation described in section 7401(2)(a)(i), (ii), or
9 (iii) of the public health code, 1978 PA 368, MCL 333.7401.
10 (b) A violation described in section 7403(2)(a)(i), (ii), or
11 (iii) of the public health code, 1978 PA 368, MCL 333.7403.
1 (3) As used in this section:
2 (a) "Lessor" means a person who owns rental property and
3 allows the rental property to be occupied by another for an
4 agreed upon consideration.
5 (b) "Rental property" means a structure or part of a
6 structure intended for residential or commercial use, and
7 includes appurtenant grounds that are intended for use by the
8 occupant.
