A bill to amend 1976 PA 451, entitled
"The revised school code,"
(MCL 380.1 to 380.1852) by adding section 1531d.
THE PEOPLE OF THE STATE OF MICHIGAN ENACT:
1 Sec. 1531d. (1) Beginning July 1, 2004, the superintendent
2 of public instruction shall not issue an initial teaching
3 certificate to a person unless the person presents evidence
4 satisfactory to the superintendent of public instruction that the
5 person meets 1 of the following:
6 (a) Has successfully completed a course approved by the
7 department in first aid and cardiopulmonary resuscitation,
8 including a test demonstration on a mannequin, and has
9 successfully completed instruction approved by the department in
10 foreign body airway obstruction management, and holds valid
11 certification in these topics issued by the American red cross,
1 American heart association, or a comparable organization or
2 institution approved by the department.
3 (b) Has physical limitations that make it impracticable for
4 the person to complete the instruction and obtain the required
5 certification under subdivision (a).
6 (2) A person who meets the requirements described in
7 subsection (1)(a) and who performs first aid, cardiopulmonary
8 resuscitation, or foreign body airway obstruction management on
9 another person in the course of his or her employment as a
10 teacher is not liable in a civil action for damages resulting
11 from an act or omission occurring in that performance except an
12 act or omission constituting gross negligence or willful and
13 wanton misconduct.
