A bill to amend 1969 PA 306, entitled
"Administrative procedures act of 1969,"
by amending sections 55 and 59 (MCL 24.255 and 24.259), as
amended by 1999 PA 262.
THE PEOPLE OF THE STATE OF MICHIGAN ENACT:
1 Sec. 55. (1) The office of regulatory reform annually shall
2 publish a an
electronic supplement to the Michigan
3 administrative code. The annual supplement shall contain all
4 promulgated rules published in the Michigan register during the
5 current year, except emergency rules, a cumulative numerical
6 listing of amendments and additions to, and rescissions of rules
7 since the last printed compilation of the Michigan administrative
8 code, and a cumulative alphabetical index.
9 (2) The Michigan administrative code and, if applicable, the
10 annual supplements shall be made available by the office of
1 regulatory reform free of charge on the internet and published in
2 printed or other electronic format for public subscription at a
3 fee reasonably calculated to cover publication and distribution
4 costs.
5 (3) The official Michigan administrative code is that
6 published or made available on the office of regulatory reform's
7 internet website free of charge.
8 Sec. 59. (1) The office of regulatory reform shall publish
9 or order published a
sufficient number of copies of the
10 Michigan register, the Michigan administrative code, and the
11 annual supplement to the
Michigan administrative code to meet
12 the requirements of
this section free of charge on
the office of
13 regulatory reform's internet website. Unless otherwise directed
14 by the office of
regulatory reform, the department of management
15 and budget shall
deliver or provide copies as follows:
16 (a) To the
secretary of the senate, a sufficient number to
17 supply each senator.
18 (b) To the clerk
of the house of representatives, a
19 sufficient number to
supply each representative.
20 (2) The copies of
the Michigan register, the Michigan
21 administrative code,
and the annual Michigan administrative code
22 supplement are for official
use only by the agencies and persons
23 prescribed in
subsection (1), and they shall deliver them to
24 their successors. The department of management and budget shall
25 hold additional copies
of the Michigan register, Michigan
26 administrative code, and the supplement for sale at a price not
27 less than the publication and distribution costs which shall be
1 determined by the office of regulatory reform. Any money
2 collected by the department of management and budget for the
3 administrative code under this subsection is to be deposited into
4 the general fund.
5 (3) A person may subscribe to the Michigan register, the
6 Michigan administrative code, and the annual supplement to the
7 Michigan administrative code if the office of regulatory reform
8 makes available printed versions of those publications. The
9 office of regulatory reform shall determine a subscription price
10 that shall not be more than the publication and distribution
11 costs.
