A bill to amend 1927 PA 175, entitled
"The code of criminal procedure,"
(MCL 760.1 to 777.69) by adding section 10c to chapter II.
THE PEOPLE OF THE STATE OF MICHIGAN ENACT:
1 CHAPTER II
2 Sec. 10c. (1) A violation of the identity theft protection
3 act may be prosecuted in 1 of the following jurisdictions:
4 (a) The jurisdiction in which the offense occurred.
5 (b) The jurisdiction in which the information used to commit
6 the violation was illegally used.
7 (c) The jurisdiction in which the victim resides.
8 (2) If a person is charged with more than 1 violation of the
9 identity theft protection act and those violations may be
10 prosecuted in more than 1 jurisdiction, any of those
11 jurisdictions is a proper jurisdiction for all of the violations.
1 Enacting section 1. This amendatory act does not take
2 effect unless Senate Bill No. 792
3 of the 92nd Legislature is enacted into
4 law.
